MAN GETS 14-YEAR JAIL TERM UNDER POCSO ACT FOR SEXUALLY ASSAULTING MINOR GIRL


A special Protection of Children from Sexual Offences (POCSO) court in Mumbai convicted a man for sexually assaulting a three and half year old child and sentenced him to fourteen years of rigorous imprisonment. The accused was sentenced under section 6 of POCSO Act for aggravated penetrative sexual assault.

WHATSAPP GROUP ADMIN ARRESTED IN MUMBAI FOR ALLEGEDLY ADDING A WOMAN


Mustaq Ali Shaikh, (24-year-old), a WhatsApp group administrator has been arrested by the Mumbai police for adding a woman’s mobile number without her consent to a group that shares pornographic content. He has been arrested under IPC sections for outraging the modesty of a woman, and under 67 and 67-A of the IT Act. He has been sent to police custody. The maximum punishment an accused could get under the IT Act, 2000, is up to five years imprisonment for the first and  if an accused commits the crime again, he can sent to jail for up to seven years jail and fined 10 lakh.

MAN HELD FOR DUPING WOMEN ON MATRIMONIAL SITE


A man from Andhra Pradesh's Prakasam District was arrested by the Cyber Crime Police in Hyderabad, after he allegedly cheated several women on matrimonial sites by demanding money from them. The accused identified as N Jeevan Kumar, was a resident of Nallamadugula village in Prakasam district of Andhra Pradesh. The accused used pictures of others to create a matrimonial profile and input false details to lure women.

UNDER SEXUAL HARASSMENT OF WOMEN AT WORKPLACE (PREVENTION, PROHIBITION AND REDRESSAL) ACT, 2013 IF A MAN TOUCHES A WOMAN INAPPROPRIATELY, YOU COULD GO TO JAIL FOR 5 YEARS


When the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, or POSH Act, was passed, the Criminal Law (Amendment) Act, 2013, was also passed and Section 354 was added to the Indian Penal Code. This defines sexual harassment and the penalties for the offence. Under this Act, violator will face 1-5 years jail and fine under Criminal Law Act, 2013 if he touches a woman inappropriately. Observing, capturing, distributing images of a woman without her knowledge will lead to 1-7 years’ jail and fine under Information Technology Act, 2000.

ACCUSED IN CRIMINAL CASE IS ENTITLED TO ‘DEFAULT BAIL’ IF POLICE FAIL TO COMPLETE PROBE


An accused is entitled to default bail under Section 167(2) of Code of Criminal Procedure after the expiry of statutory period of remand and non-filing of charge sheet by the police. An indefeasible right accrues in favour of the accused for being released on bail if the police fail to complete the probe and no charge-sheet is filed within the period of 90 days or 60 days as the case may be. The accused concerned can be released on bail if he is prepared to and furnishes the bail as directed by the magistrate/court.

UNDER POCSO ACT, CITIZENS WHO NEGLECT TO REPORT CHILD ABUSE CASE CAN LIABLE FOR IMPRISONMENT UP TO SIX MONTHS, OR A FINE


The Protection of Children from Sexual Offences (POCSO) Act considered that all citizens mandatory reporters of child abuse. As such, if a citizen fails to report a known case of child abuse or neglect she or he is liable to punishment of imprisonment for up to six months, or a fine, or both. The public can call the child helpline on 1098 to report the incidents. National Crime Records Bureau data for 2016 reports 1,278 cases of women and child rape, but this is just a fraction of the incidents as most are never reported.

CENTRE LAUNCHED A WEB PORTAL FOR LODGING COMPLAINTS ON ONLINE CHILD PORNOGRAPHY, SEXUAL ABUSE CASES


The Centre launched a portal 'cybercrime.gov.in' where citizens can file complaints about circulation of child pornography, sexually explicit materials and online sexual abuse, leading to automatic registration of FIR and action against the offenders. This will not only help the victims and complainants but also civil society organisations and responsible citizens to anonymously report complaints pertaining to child pornography, child sexual abuse material or sexually explicit material such as rape and gang rape. It will enable complainants to report cases without disclosing their identity.

DELHI POLICE BUSTED MULTI-CRORE JOB SCAM, SEVEN INCLUDING TWO GOVERNMENT OFFICIALS ARRESTED


The Delhi Police busted a multi-crore PSU Recruitment Scam and arrested seven people including two government employees. Reports inform that the scam took place within Krishi Bhawan area in the national capital where scamsters cheated youths on the pretext of providing them government jobs in the state-owned Oil and Natural Gas Corporation (ONGC). Police informed that seven men including the Class IV employees at the ministry have been arrested so far.

SEEKING SEXUAL FAVOURS PUNISHABLE UNDER NEW ANTI-CORRUPTION LAW

A senior government official said that Seeking and accepting sexual favours can be considered a bribe under the new anti-corruption law with the accused getting up to seven years jail term. The official said that under the Prevention of Corruption (Amendment) Act, 2018 investigating agencies like the CBI can now book officials for seeking and accepting sexual favours, expensive club memberships and hospitality or for providing employment to close friends or relatives among others.

SUPREME COURT APPROVED SCHEME THAT GRANTS MINIMUM RS 4 LAKH COMPENSATION TO RAPE SURVIVORS


The Supreme Court has ruled that a rape survivor will get a mandatory minimum compensation of Rs 4 lakh and, in case of gang rape Rs 5 lakh, and directed states to implement this from October 2 in accordance with a scheme framed by the National Legal Services Authority (NALSA) in consultation with Centre. The monetary relief granted under the ‘compensation scheme for women victims/survivors of sexual assault and other crimes 2018’ is not linked with trial proceedings in such cases and the survivor can approach the state or district legal services authority for compensation immediately after registration of FIR.

POLICE ARRESTED A MAN FOR CYBER STALKING HIS WIFE


A 33-year-old man from Hyderabad was arrested by the Cyber-Crime police, Rachakonda for cyber stalking his wife and sending abusive messages to her as she decided to stay away from him. Earlier the woman has filed a case of domestic violence against him. The accused warned her family of desire consequences for filing domestic violence case against him.

IN 7-HOUR TRIAL, 14-YEAR-OLD BOY PUNISHED FOR RAPE IN MADHYA PRADESH


A juvenile court in Ujjain (Madhya Pradesh) convicted and sentenced two years at a special home for a 14-year-old boy on charges of raping a minor girl, within seven hours. The court ordered sending the boy to a remand home in Madhya Pradesh's Seoni district for serving the sentence. The crime took place on August 15 and the entire process, from registration of the case to pronouncement of judgement, was completed in five days.

SESSIONS COURT IN MADHYA PRDESH SENTENCED DEATH TO TWO MEN FOR RAPING 7-YEAR-OLD


A session’s court in Mandsaur (Madhya Pradesh) awarded death sentence to two men for the rape and attempted murder of a seven-year- old girl in Mandsaur. The court said that it’s a rarest of rare case because the accused committed an abhorrent crime by not just raping a minor but also injuring her private parts with a knife and leaving her for dead. They don’t deserve any leniency.

POCSO COURT IN MUMBAI SENTENCED 3 YEARS JAIL TO A MUMBAI TEACHER FOR MOLESTING STUDENTS

A special Protection of Children from Sexual Offences (POCSO) Act court in Mumbai convicted and sentenced a 40-year-old algebra teacher from a suburban school in Mumbai to three years jail for sexually harassing minor students in 2013. While the school principal said 39 students had given written complaints to her, three of them deposed before the trial court. The court allowed the plea of the accused to be released on bail to file an appeal and told him to pay a fine of Rs 25,000 to the three survivors who deposed.

MINOR’S CONSENT FOR SEX IS NO CONSENT AT ALL: MADHYA PRADESH HIGH COURT

The Madhya Pradesh High Court said that a minor’s ‘consent’ for sex is no consent while setting aside a session’s court acquittal of an accused in a child rape case. The session’s court had based the acquittal on medical report, which said there was no injury on the survivor’s body, and noted that she did not raise an alarm when the assault took place. This gives sufficient reason to believe that it was consensual sex, the lower court felt. Since the High Court noted that the girl was less than 14 years old, and said that even if she had consented, it couldn’t be treated as “consensual sex”. Hence, an offence under Section 376 IPC is disclosed.

WOMEN ARE BEING RAPED LEFT, RIGHT AND CENTRE: SUPREME COURT AND PULLED UP BIHAR GOVERNMENT OVER MUZAFFARPUR SHELTER HOME RAPE CASE

The Supreme Court expressed concern over incidents of rape in the country and said that women are being raped “left, right and centre”. The Apex Court referring to the National Crime Records Bureau (NCRB) data, said that a woman is raped every six hours in the country. While taking suo moto cognizance of the Muzaffarpur shelter home sexual abuse case, the Supreme Court pulled up Bihar state government for funding the NGO running the shelter home where girls were being allegedly raped and sexually abused. The court said that it had not restrained the police authority from conducting probe and if they want to question the alleged victims, they would have to take assistance of professional counsellors and qualified child psychiatrist in consultation with National Institute of Mental Health.

TELLING A WOMAN TO COOK, DO CHORES PROPERLY DOES NOT MEAN ILL-TREATMENT: BOMBAY HIGH COURT

The Bombay High Court has granted relief to a man accused of driving his wife to suicide by ruling that asking a woman to cook properly or do household work does not amount to ill-treatment. The court made the observations while upholding the acquittal of a Sangli resident and his parents, who were accused of driving his wife to kill herself in a 17-year-old case.

A COURT IN DELHI REFUSED LENIENCY TO MAN WHO RAPED HIS DAUGHTER AND AWARDED LIFE IMPRISONMENT TO HIM

A Court in Delhi awarded life imprisonment to a man for raping his minor daughter repeatedly for three years starting 2010. While sentencing the accused the court observed that showing leniency in such cases of incest will be disservice to the society. The girl had lost her mother when she was an infant and needed her support for proper and healthy growth. The court also granted a compensation of Rs 4 lakh for the survivor’s rehabilitation saying that children are a supremely important national asset and the future well-being of the nation depends on how they grow and develop.

19-YEAR-OLD GOT DEATH SENTENCE FOR RAPING INFANT UNDER THE NEW AMENDMENTS TO THE CRIMINAL LAWS (RAJASTHAN AMENDMENT) BILL, 2018

A lower court in Rajasthan awarded death sentence to a 19-year-old youth for raping a seven-month-old child 73 days ago, making it the first such sentence in the state under the new amendments to the Criminal Laws (Rajasthan Amendment) Bill, 2018, the minimum punishment for raping girls below 12 years of age is 14 years in prison, while convicted accused could even be given the death penalty.

CABINET APPROVED BILL SEEKING DEATH FOR RAPE OF GIRLS BELOW 12 YEARS AND TABLE BILL IN THE MONSOON SESSION OF PARLIAMENT

The Criminal Law (Amendment) Bill 2018 which provides for stringent punishment, including death penalty for those convicted of raping girls below the age of 12 years, has been approved by the Union Cabinet paving the way for its introduction in the monsoon session of parliament. According to the bill, the minimum punishment for rape of a girl below 12 years will be 20 years of imprisonment extendable to life in prison or death sentence, in case of rape of a girl under 16 years, the minimum punishment has been increased survivors of from 10 years to 20 years, extendable to life imprisonment, which means jail term till the convict’s natural life.

SUPREME COURT ASKED PARLIAMENT TO BRING IN SPECIAL LAW AGAINST LYNCHING

The Supreme Court condemned that the recent spate of lynchings as horrendous acts of mobocracy and told the Parliament to make lynching a separate offence. The court made this observation while hearing pleas seeking directions to formulate guidelines to curb vigilantism. The court also passed a slew of directions to be implemented by the States and Central government to ensure that law and order is maintained and people are prevented from taking the law into their hands.

PERSONS WHO THREATENS LAWYERS MAY FACE SEVEN YEARS JAIL TERM: SOON BILL BY MADHYA PRADESH GOVERNMENT TO PROTECT LAWYERS

The Madhya Pradesh state cabinet gave its approval to the Advocates Protection Act. Under this Act, a person accused of exerting undue pressure on a lawyer or obstructing their work would lead to seven years of jail with provisions of fine up to Rs. 10,000. The government is preparing to bring an Ordinance to implement this Act soon. The government will present the bill in the monsoon session of the Assembly.

SUPREME COURT REJECTED REVIEW PETITION OF THREE CONVICTS IN NIRBHAYA GANGRAPE CASE AND UPHELD THE DEATH SENTENCE

The Supreme Court uphold the death penalty of three convicts in a gang rape-cum-murder of a medical student inside a moving bus in Delhi in 2012, and rejected the review petitions of three of the four condemned convicts seeking review of the apex court’s ruling of  May 2017 decision to award death penalty to all four.

IF THERE IS NO PREVIOUS ANIMOSITY OR MOTIVE TO KILL, IT’S NOT MURDER: HYDERABAD HIGH COURT

The Hyderabad High Court said that if there is no previous animosity or intention or motive for the accused to kill a person, the courts will scale down the offence to the one under Section 304 Part I (punishment for causing death by negligence) and not the one of murder under Section 302 IPC (punishment for murder), and altered life imprisonment for the offences punishable under Sections 302 and 498-A of IPC given by the Sessions Judge to the one under Section 304 Part-I IPC, and sentenced the appellant to rigorous imprisonment for a period of 10 years. The verdict came after the accused approached the High challenging the judgment of the Mahila Sessions Judge, Vijayawada.

POLICE ARRESTED A PERSON FOR DUPING 25 MEMBERS ON PRETEXT OF PROVIDING GOVERNMENT JOBS

Hyderabad Police had registered a case against a person identified as Premsagar for forging the signature of CM’s special secretary in issuing fake employment letters. Having found that the accused has cheated over 25 persons and collected a sum of over Rs 1 crore from his victims, the case has been transferred to Central Crime Station (CCS) for further investigation. According to police, Premsagar issued job offer letters to his victims for jobs as junior assistant in Revenue department.

POLICE ARRESTED HYDERABAD CITY-BASED CRIMINAL GANG FOR DUPING NRI WITH RS 60 CRORE WORTH ‘FAKE BITCOINS’

The Cyberabad cyber-crime cell arrested four fraudsters for duping an NRI techie to the tune of Rs 35 lakh on the pretext of providing huge loans to buy a plot of industrial land. According to the police, the suspect transferred ‘Bitcoins’ worth Rs 60 crore into the victim’s wallet which were later found to be fake. Police recovered Rs 9 lakh cash, four mobile phones and a laptop from their possession.

CYBERABAD POLICE BUSTED FAKE EMIGRANTS RACKET, AND ARRESTED THREE PASSENGERS, TWO AGENTS

The Cyberabad police and Bureau of Immigration sleuths busted a fake Protector of Emigrants (POE) documents racket at Rajiv Gandhi International Airport and arrested three persons. In another case involving a job aspirant from Maharashtra, agents from East Godavari are learnt to have duped him by providing a tourist visa instead of a work visa. Two agents were arrested in this case. The police booked two separate cases under cheating and forgery sections of the Indian Penal Code (IPC) based on a complaint lodged by Bureau of Immigration officials and the victims.

ENFORCEMENT DIRECTORATE MOVED COURT TO DECLARE VIJAY MALLYA AN FUGITIVE OFFENDER UNDER NEW FUGITIVE LAW

The Enforcement Directorate (ED) moved a special court in Mumbai to declare the defunct Kingfisher Airlines' chief Vijay Mallya as a fugitive economic offender under the newly-promulgated Fugitive Economic Offenders Ordinance. The agency also sought court orders for confiscating all the properties of Mallya worth Rs 12,500 crore, which includes immovable properties as well as movable properties in form of shares.

SUPREME COURT ASKED REPORT FROM ALL 24 HIGH COURTS ON THE PACE OF DISPOSAL OF CHEQUE BOUNCE CASES

The Supreme Court has sought an action-taken report from all 24 High courts on the pace of disposal of cheque bounce cases, which have been clogging the courts for years, and directed the registrar generals of every High Court to ready their reports and send it to the Secretary-General of the Supreme Court, who will then collate all the reports and present them on July 15, the next date of hearing.

SURVEY INSPECTOR IN ANDHRA PRADESH BOOKED UNDER SPECIAL COURT ACT BY ACB FOR AMASSING ILLEGAL ASSETS

The Anti-Corruption Bureau filed a charge sheet against a suspended Inspector of Survey (in Survey and Land Records Department, vizianagaram district, Andhra Pradesh), who amassed over Rs. 8 crore illegal assets under the Special Court Act 2016. The Act allows the government to confiscate and sell, use or mortgage properties earned illegally by government officials.

WOMAN BOOKED UNDER POCSO ACT FOR ABUSING MINOR BOY

A 45-year-old woman was booked under Prevention of Children from Sexual Offences Act (POCSO) for raping a 15-year-old boy at Vambay Colony in Vijayawada. The incident came to light after the boy's family lodged a police complaint. Police booked a case against the woman under Section 4 of the POCSO Act and arrested her and sent to judicial custody.

SCHOOL CAN'T SEND CHILDREN OUT OF CLASSROOM, DIRECTOR AND PRINCIPAL CONVICTED BY A DELHI COURT

A court in Delhi sentenced the principal and director of a city-based school to two-months’ imprisonment according to the Juvenile Justice (Care and Protection) Act, and also asked them to pay Rs 2.5 lakh each as compensation, for cruelty and causing mental trauma to a minor student by stopping her from entering the classroom.

DEPUTY DIRECTOR OF TELANGANA STATE SPORTS AUTHORITY HELD ON BRIBE CHARGES

The Anti-Corruption Bureau arrested G. Venkataramana, deputy director, Telangana State Sports Authority, for accepting a bribe of Rs 1 lakh from a hockey player, in return for a copy of the allotment of priorities for admission into medical college under the sports quota. The officials registered a case of criminal misconduct against Venkatramana under section 7, 13 (1), (d) and Sec. 13(2) of the Prevention of Corruption Act.

HYDERABAD HIGH COURT ASKED REPORTS FROM STATES OF ANDHRA PRADESH, TELANGANA ON OVERCROWDING OF JAILS

The Hyderabad High Court issued notices to the Andhra Pradesh and Telangana governments, asking them to file comprehensive reports within three weeks in a taken up PIL relating to overcrowding of prisons in both the States and lack of adequate staff to maintain inmates. The court was dealing with the suo motu PIL following recent directions by the Supreme Court in a case relating to “Inhuman conditions in 1,382 prisons.
