While commuting death sentence awarded to a man convicted for
rape and murder of a five year old girl, the Supreme Court observed that death
sentence must be imposed only when life imprisonment appears to be an altogether
inappropriate punishment. The court modified the death penalty awarded to convict and sentenced him
to life imprisonment with a minimum 25-year of jail without remission for
raping and killing a minor girl in 2015. However the court rejected the plea of
the accused for granting him the benefit of the doubt, and said that courts are
not obliged to make efforts either to give latitude to the prosecution or
loosely construe the law in favour of the accused.
