DEATH SENTENCE CAN BE IMPOSED ONLY WHEN LIFE IMPRISONMENT APPEARS TO BE AN INAPPROPRIATE PUNISHMENT: SUPREME COURT


While commuting death sentence awarded to a man convicted for rape and murder of a five year old girl, the Supreme Court observed that death sentence must be imposed only when life imprisonment appears to be an altogether inappropriate punishment. The court modified the death penalty awarded to convict and sentenced him to life imprisonment with a minimum 25-year of jail without remission for raping and killing a minor girl in 2015. However the court rejected the plea of the accused for granting him the benefit of the doubt, and said that courts are not obliged to make efforts either to give latitude to the prosecution or loosely construe the law in favour of the accused.

MINOR TURNING HOSTILE WON’T TAKE POCSO ACCUSED OFF HOOK: BOMBAY HIGH COURT AND SAID ONUS ON ACCUSED TO ESTABLISH INNOCENCE


The Bombay High Court has ruled that even if a minor survivor in a sexual assault case turns hostile, under POCSO Act the responsibility is on the accused to establish innocence, and upheld a 10-year jail term given to Govandi youth for aggravated sexual assault in 2013 of a nine-year-old girl. The High Court said that POCSO was a special law, where presumption of guilt was on the accused; it is presumed the accused has committed the crime unless he can prove his innocence beyond doubt.

PRIEST SENTENCED TO 10-YEARS RIGOROUS IMPRISONMENT FOR RAPING MINOR GIRL


A Hyderabad city court sentenced a priest from Bowenpally to undergo rigorous imprisonment for 10 years and imposed a fine of Rs 3,000 for sexually assaulting an 11-year-old girl at her residence in Bowenpally in 2014.

POLICE BUSTED MEGA JOB RACKET AND ARRESTED 14 PERSONS FOR DUPING JOB ASPIRANTS OF 70 CRORE


The Cybercrime Wing of the Cyberabad Police busted an international job racket and arrested the chief executive officer of an Indian IT company, Ajay Kolla, and 13 of his staff, who duped job seekers from four continents. It is estimated that they cheated one lakh job seekers of about `70 crore on the promise of finding them jobs.

RAPIST SENTENCED TO 10 YEARS’ JAIL WITHIN 11 MONTHS OF CASE REGISTRATION


A 50-year-old man from West Marredpally (Hyderabad) was convicted under sections of the Protection of Children from Sexual Offences (POCSO) Act for raping and sexually abusing the four-and-half-year old. A special Protection of Children from Sexual Offences (POCSO) court after 11 months of trial found the man guilty under Section 5(m) of the POCSO Act (aggravated penetrative sexual assault on child under age of 12) and Section 363 of the IPC (kidnap) and sentenced him to 10 years of rigorous imprisonment and fine of Rs 4,000. The case will be forwarded to the District Legal Service Authority (DLSA) to decide the quantum of compensation to be awarded to the survivor. “Refer the matter to the District Collector so that appropriate compensation can be given to the victim girl at the earliest,” the judgement said.
